New helmet safety rating scheme could save 50 lives a year

London, 22 November/GNN/ -- pioneering new Government motorcycle helmet safety rating scheme whichcould save the lives of 50 riders a year was officially launched today by Road Safety Minister Jim Fitzpatrick.

In a world first, SHARP - the Safety Helmet Assessment and Rating Programme -will give an independent rating of how much protection a helmet can providein an impact. Helmets will be rated from 1 to 5 stars depending how wellthey perform in our laboratory tests.

All helmets on sale in the UK must offer the wearer a minimum levelof protection, but tests show there are real differences in safetyperformance. SHARP's objective advice, based on rigorous testing, willhelp riders choose a safer helmet by measuring the extent to which a helmetexceeds the minimum standards.

Speaking at the Road Safety Expo 07 in London today, Road Safety MinisterJim Fitzpatrick said:
"Our research indicates that even though all helmets have to reach a minimumlegal standard, safety performance can vary by as much as 30%. The SHARPscheme being officially launched today will allow riders to select a saferhelmet on the basis of a simple star rating system."

This is a vital step forward. Motorcyclists are one of the single mostvulnerable groups on GB roads today. They account for just 1% of all roadtraffic, but for 20% of all those killed or seriously injured. We estimatethat if all riders wore helmets that scored well in our rating system,the SHARP scheme could save up to 50 lives a year."During his speech, Jim Fitzpatrick also announced the launch of the DrivingStandard Agency's Enhanced Rider Scheme. This is aimed at enhancing the roadsafety skills of the motorcycle and scooter riders already on the roads. TheAgency has been working with the motorcycle industry to devise a new trainingpackage for the benefit of all riders with a full motorcycle licence. Thosewho pass the Enhanced Rider Scheme will get a certificate that will put themin line for discounts on their insurance.

The first SHARP results are expected to be available next Spring, withthe majority of helmets on the market tested before the end of 2008. Earlyresults show that good performance is not restricted to premium price helmets.

Takata's Motorcycle Airbag Named 2008 Automotive News PACE Award Finalist

AAA Opposes HB 4749, Which Provides 'Opt-Out' Option for State's Helmet Law

$100 fee makes it OK to go without helmet?
DEARBORN, Mich., Oct. 11 /PRNewswire/ -- The State House passed legislation today (October 11) that would enable motorcyclists to ride without their helmets on Michigan roads. In their latest bid to rid riders of their helmets, special interest groups in Lansing have proposed an 'opt-out' solution. For a $100 fee, motorcyclists would have the chance to buy their way out of a helmet.
American Bikers Aiming Toward Education (ABATE) conceived the bill, which would require riders to be 21 years or older, licensed to operate a motorcycle for at least two years, complete a motorcycle safety course and have insurance or security of $20,000 for first-party medical benefits in the event of an accident.
"It's like a 'get out of jail free card,'" said AAA Michigan Community Safety Services Manager Jack Peet. "Those who can afford the fee don't have to wear a helmet; everyone else does."
The reality, added Peet, is that no one can afford HB 4749, which would result in 22 additional fatalities each year, along with 132 more incapacitating injuries, 610 other injuries and $140 million in added economic costs to Michigan citizens.
"If the mandatory helmet requirement is repealed or waived through a fee, there will be a significant increase in severe head injuries and deaths," said Peet. "Studies show that in a crash, unhelmeted motorcyclists are three times more likely than helmeted cyclists to suffer traumatic brain injuries."
In addition, motorcycle crashes account for a disproportionate share of money paid out of the Michigan Catastrophic Claims Association (MCCA), a fund which is supported by a surcharge on every auto insurance policy in this state. Although motorcyclists represent 1.7 percent of the assessments paid into the MCCA, they account for 6.7 percent of all claims reported.
Since its inception in 1978, MCCA has reimbursed member insurers more than $210 million for 503 motorcycle injury claims exceeding the threshold. Total reimbursement for all claims exceeds $4.4 billion. If the mandatory helmet law is repealed, serious injuries to motorcyclists will rise. Since Michigan's no-fault law allows lifetime benefits for all "reasonable and necessary" medical costs, the number of claims and the amount paid by the MCCA to reimburse insurance companies will increase, causing all policyholders in Michigan to pay more.
The $20,000 first-party medical benefit touted by ABATE, says Peet, wouldn't begin to cover these catastrophic expenses.
In addition to increased medical costs passed on to taxpayers, Motorcycle deaths and injuries are on the rise after the repeal of mandatory helmet laws in Florida, Kentucky and Louisiana. The National Highway Traffic Safety Administration found that in the three years after Florida's repeal of its mandatory helmet law in 2000, 933 motorcyclists were killed, an 81 percent increase.
Another study found that fatalities grew by more than 50 percent in Kentucky and 100 percent in Louisiana after those states struck down mandatory helmet laws.
Opponents of the mandatory helmet law believe that it infringes on individual freedom of choice and the right to privacy. They argue that individuals who do not wear helmets harm mainly themselves. However, that is really not the case. The consequences of that person's decision not to wear a helmet is borne by all of society through higher insurance premiums, lost productivity and increased health care costs.
In Florida after the helmet law was repealed, the cost of hospital care for motorcycle injuries grew from $21 million to $44 million in the 30 months after the law changed.

Michael Guilford dies in Motorcycle accident

GAINESVILLE — Florida walk-on football player Michael Guilford was killed early Friday morning in a motorcycle accident in Gainesville.
Guilford, a redshirt freshman from Quincy, crashed his 1998 Kawasaki motorcycle into a median around 1 a.m, killing both him and passenger Ashley Slonina, also a Florida student. Neither Guilford nor Slonina was wearing a helmet, Gainesville Police spokesman Keith Kameg said.

Police believe excessive speed was a factor in the accident. Police are also investigating whether alcohol was involved. Guilford, nicknamed "Sunshine" because of his blonde hair, was a star on the scout team, frequently imitating the opposition's quarterback. He acted as Troy Smith as the Gators prepared to face Ohio State in the national championship game, and acted as Kentucky's Andre Woodson in practice Thursday, according to the Tampa Tribune.

Keep Your Balance Program Introduced at Tomahawk Fall Ride

MILWAUKEE, Sept. 27 /PRNewswire/ -- Miller Brewing Company and the American Motorcyclist Association (AMA) have partnered to create Keep Your Balance, a comprehensive program intended to promote safe motorcycle riding practices and responsible alcohol consumption. Miller believes that individual responsibility is enhanced by the ability to make informed choices. Yoshimura Suzuki's Ben Spies Clinches the AMA Superstock Championship with One Round Remaining

Death-crash doctor spared jail in death of motorcyclist

A doctor walked free from court today over the death of a motorcyclist after she drove the wrong way down a dual carriageway.


Dr Thuli Whitehouse, 27, was given a 51-week prison sentence but it was suspended for two years by a judge who at her trial had called her a "golden young woman".

She was also banned from driving for four years and must do 150 hours' community work.
The Murrell family later issued a statement through Thames Valley Police which said: "We are very upset by the verdict reached today.

"We appreciate no sentence will bring back our son and father, but we feel the sentence is far too lenient and we will be appealing against the sentence."

Whitehouse had been found guilty by a jury of causing the death of motorcyclist Robert Murrell, of Southmoor, near Abingdon, in a crash on the A420 near Appleton in June last year.
Whitehouse turned left, the wrong way, out of the Appleton junction and drove for a short distance down the eastbound carriageway and into the path of Mr Murrell, 33. He was killed and the doctor's boyfriend, Dr Hugh Grant-Peterkin, critically injured.

During her trial, the jury heard that Mr Murrell, of Southmoor, near Abingdon, was travelling at speeds of between 87mph and 103mph and died instantly.

Judge David Morton Jack was told Whitehouse missed nine separate road markings and signs instructing her to turn left on to a dual carriageway.

Instead, the doctor drove straight across the A420, near Appleton, to reach a gap in the crash barriers to get to the opposite side of the road.
The jury heard from witnesses who saw her at the end of the side road on to the busy road, reverse and then go to the other side of a traffic island.

Whitehouse, of Upper Cheltenham Place, Bristol, told the jury that she must have been "confused" and would never drive dangerously.

The jury took less than an hour to find her guilty of causing death by dangerous driving.

Members of 'Outlaws Motorcycle Club' Indicted in Detroit on Violent Crime, Drug and Gun Charges

Arrests, Searches Part of Ongoing Nationwide Initiative Targeting the 'Outlaws'

WASHINGTON, Aug. 15 /PRNewswire-USNewswire/ -- Sixteen members of the Outlaws Motorcycle Club were indicted yesterday by a federal grand jury in Detroit on charges including violent crime in aid of racketeering, illegal drug distribution and gun violations, the Department of Justice announced today. The indictment, which was unsealed today, is part of an ongoing nationwide law enforcement initiative targeting the violent gang, which included the arrest of 15 Outlaws members in Boston last month on drug and firearms charges.
Attorney General Alberto R. Gonzales announced the indictment of the 16 charged defendants today at a news conference in Detroit with U.S. Attorney Stephen J. Murphy of the Eastern District of Michigan, Deputy Director Ronnie Carter of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), Deputy Assistant Director Daniel Roberts of the FBI's Criminal Investigative Division, and Gang Squad Chief Kevin Carwile of the Justice Department's Criminal Division.
Law enforcement authorities also initiated searches today in connection with the ongoing nationwide investigation of the Outlaws. Agents from the Detroit offices of the ATF, assisted by state and local law enforcement partners, executed a search warrant at the Outlaws Detroit Westside clubhouse. Searches were also conducted at several Outlaws locations in the state of Florida.
The Outlaws Motorcycle Club has been identified as an international criminal organization whose members and associates engage in acts of violence including murder, attempted murder, assault, narcotics distribution, and firearms and gambling offenses. The Outlaws are a structured and hierarchical gang, divided into multiple regions in the United States. The Outlaws also have members worldwide, including Europe, Asia and Canada. The Outlaws have a long-standing violent history with the Hells Angels Motorcycle Club, including assaults/batteries, shootings and fatalities.
"One of our top priorities at the Department of Justice is easing the grip of fear that gang violence brings to some communities," said Attorney General Alberto R. Gonzales. "We have worked to achieve that through a partnership with state and local authorities that targets violent gangs, including the Outlaws, city by city, neighborhood by neighborhood, until the threat of gang-related violence is reduced. The Detroit indictment was the result of "Operation Broken Spoke," "Operation Detroit Mugger," and "Operation End Game," a five-year investigation by the ATF, the FBI, the National Drug Intelligence Center (NDIC), Michigan State Police, the Detroit Police Department, the South Bend (Ind.) Police Department, and the Fort Wayne (Ind.) Police Department.
The 16 indicted leaders, members and gang associates of the Fort Wayne, Indianapolis, Detroit Eastside, Detroit Westside, Downriver and Bay City Outlaws' chapters were charged with various crimes, including: violent crimes in aid of racketeering; conspiracy to commit violent crimes in aid of racketeering; distribution and possession with intent to distribute cocaine, methamphetamine, marijuana, and hashish; being a felon in possession of a firearm; and sale of a firearm to a known felon. The Outlaws "Black Region" president, Leroy Frasier, who oversees the Michigan and Indiana Outlaws, was also charged with being a felon in possession of a firearm. The former Detroit Westside Chapter Sergeant of Arms/Enforcer, Edward Gallagher, was charged with selling a firearm to a known felon. Additionally, former Outlaw Westside Vice President William Merfert was charged as being in possession of a firearm following three prior felony convictions, a charge that carries a 15-year minimum mandatory term of imprisonment upon conviction.

The 18-count indictment alleges that the Outlaws Motorcycle Club is an enterprise whose members allegedly committed, attempted, and threatened to commit acts of violence to protect and expand the gang's criminal operations. Several of the defendants were charged with allegedly assaulting various members of the rival Hells Angels Motorcycle Club, in some cases with dangerous weapons including a cane, a hammer, and motorcycle parts. Several defendants allegedly trafficked in the sale of drugs, including methamphetamine, marijuana, hashish and cocaine, while others were charged with various firearms offenses for either being a felon in possession of a handgun, or selling a firearm to a prohibited person.
The indictment contains a criminal forfeiture allegation, which sets forth property, vehicles, motorcycles, weapons and currency that was either used to conduct or facilitate illegal activities, or which were proceeds from the Outlaws' criminal activities.

The charges of violent crime in aid of racketeering carry maximum statutory sentences of up to 20 years in prison. The separate drug counts in the indictment carry various maximum statutory sentences, including up to 40 years in prison for distribution of cocaine and up to life in prison for the distribution of methamphetamine. Defendants also face various maximum sentences on the gun charges, such as a mandatory minimum of 15 years in prison for possession of a firearm following three prior felony convictions.
The Detroit case is being prosecuted by Assistant U.S. Attorneys Diane Marion and Julie Beck of the Eastern District of Michigan, and Trial Attorney Amy Sirignano and Bryan Reeves of the Criminal Division's Gang Squad in Washington, D.C.
The Detroit case follows the arrest of 15 Outlaws members in Taunton, Mass. Thirteen individuals were charged by an indictment returned by a federal grand jury in the District of Massachusetts, while two were arrested on charges in a criminal complaint. "Operation Roadkill," announced by the U.S. Attorney's Office in Boston on July 31, 2007, was a two-year investigation by the FBI, the Massachusetts State Police, and the Brockton Police Department that resulted in federal charges including conspiracy to possess with intent to distribute cocaine and marijuana. The indictment also charged the former president of the Taunton Outlaws with possessing a firearm in furtherance of a drug trafficking crime. The indictment alleges that Outlaws in Massachusetts engaged in violent criminal activities, including an ongoing war with the Hells Angels that resulted in a number of shootings and fatalities.
Eighteen firearms were recovered during the execution of arrest warrants in connection with the Massachusetts indictment, including an AR-15 assault weapon and high-capacity rounds of ammunition. Agents recovered approximately $100,000 in connection with the investigation and also seized numerous vehicles. The FBI executed a search warrant at the Outlaws clubhouse in Taunton and recovered numerous weapons including machetes and knives, along with Outlaws paraphernalia and a large Nazi flag.
In February 2006, Attorney General Gonzales unveiled an initiative to combat gang violence across the United States. The anti-gang strategy is designed to prioritize prevention programs to provide America's youth and offenders returning to the community with opportunities that help them resist gang involvement. The initiative also calls for robust enforcement policies when gang-related violence occurs, and expands the successful Project Safe Neighborhoods program to include new and enhanced anti-gang efforts. The law enforcement actions in Detroit, Massachusetts and Florida are the result of the Attorney General's anti-gang initiative and the joint strategic and priority targeting of violent street gangs by the ATF, the FBI, the National Gang Targeting, Enforcement and Coordination Center (GangTECC) and the National Gang Intelligence Center (NGIC) and state and local law enforcement. The Criminal Division's Gang Squad, a specialized group of federal prosecutors charged with attacking the most significant regional, national and international gangs in the United States, assisted in this case and in the implementation of the Justice Department's initiatives to combat gang violence across the country.

Settlement reached in suit vs. Billy Lane

DaimlerChrysler, chopper builder Billy Lane and the family of a Sebastian Inlet park ranger killed in a Labor Day accident that police say was caused by drunk-driving have reached a confidential settlement, the deceased man’s family said today.
"We would like to personally show our gratitude and heart-filled thanks to all of the people throughout the nation that have showed us their support, love and caring," Byron Morelock, brother of Gerald Morelock, said in a statement signed by the family.
"My family may not have made it through these hard times if it wasn't for your caring and sympathy," he said.
The settlement came 10 months after Morelock's mother sued Lane, 37, and DaimlerChrysler -- which provided Lane with the Dodge pickup truck he was driving -- over the fatal crash in which police said Lane crossed a double-yellow line and hit Gerald Morelock's mini-Yamaha motorcycle.
The suit alleged Lane, who police say had a blood-alcohol level of .192 the night of the accident, and DaimlerChrysler, which the family said used Lane's fame to advertise its vehicles despite prior driving citations on Lane's record, were liable for auto negligence.
Byron Morelock said it took about 10 hours of "grueling" debate Monday before an agreement was reached. No details of the agreement were made public.
Lane still faces a criminal trial in which he could be sentenced to a maximum 15 years in prison if convicted of DUI manslaughter.
A trial date has not been set.

YORK, Pa., Feb. 1 /PRNewswire-FirstCall/ -- Harley-Davidson Motor Company expressed disappointment at the union vote yesterday that rejected a proposed new collective bargaining agreement for employees and authorized a strike at its final assembly operations in York, Pa. A strike at the facility is expected to occur as early as 12:01 a.m. February 2, when the current contract expires.
As a result of the pending strike, production of Touring and Softail motorcycles at Harley-Davidson's operations in York has been suspended.
"We are obviously disappointed by the union's decision," said Fred Gates, General Manager of Harley-Davidson's operations in York. "The proposed contract was structured to help manage future costs that could be detrimental to our business over the long term," Gates said. "While Harley-Davidson is a strong company today, we don't want to find ourselves in ten years in the same position that the Detroit auto industry is in now."
The proposed contract provided for a four percent wage increase in each of the three contract years. Two percent of the increase was dependent on the union accepting the Company's salaried health care plan or another plan that would save the Company an equal amount of money. The Company's union employees in York currently pay no premium for health insurance coverage and minimal out of pocket costs. The proposal would have doubled the Company's 401(k) contribution match and would have provided a special monthly retirement supplement for certain employees who retire during the contract period. The proposal also would have instituted a second-tier wage and benefit plan for new employees hired after February 2, 2007. For example, under the two-tier structure, new assembly worker hires would have earned $18.25 per hour in the first year of the contract, compared to $20.78 per hour for current assembly workers in the first year of the contract.
Harley-Davidson production employees in York are represented by International Association of Machinists and Aerospace Workers (IAM) Local 175.

Machinists Slam Harley 'Betrayal'

WASHINGTON, Feb. 1 /PRNewswire-USNewswire/ -- More than 2,700 Machinists union members at Harley-Davidson in York, PA, were forced out of their workplace today after voting to reject a contract that union leaders called a betrayal to workers at the iconic company.
"Harley-Davidson has no business behaving like they're on the brink of bankruptcy," said Tom Buffenbarger, international president of the International Association of Machinists and Aerospace Workers (IAM). "When Harley was flat on its back in the 1980's, it was union members who refused to let it die. Harley went on to become an international success story but they've obviously forgotten how they got this far."
"They don't respect workers as much as their stock options," declared District 98 Directing Business Representative Tom Boger about company leaders who reported record revenue of more than $1.6 billion for the third quarter of last year.
Harley proposed pay increases that would go into effect in 2008 and 2009, but only if workers agreed to pay more for health care costs.
"These workers build pride into every motorcycle Harley sells and they deserve a fair contract that reflects the success they helped create," said Buffenbarger. "Instead, this company's management is risking a successful 26- year partnership for a few cents more in profits. It's incredibly stupid and shortsighted."
The contract with Harley-Davidson expires on February 2 at 12:01 am. Strike preparations are underway.
